These Terms and Conditions set out the basis on which Rubbish Removal Mayfair provides rubbish removal and waste collection services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions:
Customer means any individual, business, landlord, tenant, managing agent or organisation that books or uses our services.
Services means any rubbish removal, waste collection, bulky item collection, clearance, loading, transportation, disposal or related services provided by us.
Waste means any rubbish, refuse, junk, unwanted items, household waste, commercial waste or other materials presented by you for collection, excluding any prohibited items identified in these Terms and Conditions or under applicable law.
We, us and our means the operator of Rubbish Removal Mayfair.
We provide on-demand and scheduled rubbish removal and waste collection services for domestic and commercial customers. Our services typically include attending the agreed location, loading waste from accessible areas, transporting it and arranging disposal or recycling in accordance with waste regulations.
We reserve the right to refuse any collection where the waste is unsafe to handle, not as described at the time of booking, includes prohibited items, or where access is unsafe or impossible.
3.1 Booking request
You may request a booking by telephone, email or online enquiry form, where available. When making a request, you must provide accurate and complete information about the nature, volume, weight and location of the waste, access arrangements, property type and any parking restrictions.
3.2 Quotations
Any quotation we give, whether verbal or written, is based on the information you supply at the time of enquiry. Quotations are normally given as an estimated price or as a price band depending on the expected volume and type of waste. If, on arrival, the waste differs from the description provided, or additional work is required, we may adjust the quotation before commencing work.
3.3 Acceptance of booking
A booking is only confirmed when we have accepted it and provided you with a date and time window for the collection. We reserve the right to decline a booking request at our discretion.
3.4 Arrival windows
We will provide an estimated arrival time window for the collection. While we use reasonable efforts to attend within this window, times are approximate and may be affected by traffic, earlier bookings, access issues or other factors beyond our control. We will not be liable for any loss arising from delay or failure to attend at the exact scheduled time, but we will use reasonable endeavours to keep you informed of any significant changes.
4.1 Access requirements
You must ensure that we have safe, reasonable and lawful access to the property and to the waste to be collected. This includes providing any necessary information about security codes, entry systems, concierge arrangements or site rules in advance.
4.2 Parking arrangements
You are responsible for ensuring that suitable parking is available for our vehicle as close as reasonably possible to the collection point. If parking permits, visitor passes, loading bay reservations or other arrangements are required, you must arrange these in advance or, where agreed, reimburse us for any parking charges incurred.
4.3 Failed access
If we are unable to gain access to the property or to the waste at the agreed time due to circumstances within your control, we may charge a call-out fee and, if you wish to rebook, a further charge may apply. Any deposits paid may be retained in these circumstances to cover our costs.
5.1 Acceptable waste
We collect most common household and commercial non-hazardous waste, including general rubbish, furniture, appliances, garden waste and light construction debris, subject to weight, volume and safety limits.
5.2 Prohibited and restricted items
We do not collect certain types of waste, including but not limited to hazardous, toxic, clinical or medical waste, asbestos, chemicals, solvents, gas bottles or cylinders, certain electricals requiring specialist treatment, biological waste, sharps, explosives or any items that we reasonably consider to present a health and safety risk. If you are unsure whether your waste is acceptable, you must ask us in advance.
5.3 Misdescribed waste
If, on arrival, we find that the waste includes prohibited items or materially differs from the description you provided, we may refuse to collect all or part of the load, or adjust the price accordingly. We may charge a wasted journey fee where we are unable to proceed due to misdescribed or unsafe waste.
6.1 Pricing basis
Our charges are generally based on the volume and weight of waste collected, the time taken to load, any additional labour requirements and disposal costs. Where practical, we will confirm the price before commencing work following an on-site assessment by our team.
6.2 Additional charges
Additional charges may apply for difficult access, excessive carrying distances, dismantling of items, extra labour, out-of-hours collections, heavy materials, waiting time, parking charges or congestion-related costs. We will explain these charges where reasonably possible before or during the service.
6.3 Payment terms
Unless we agree otherwise in writing, payment is due in full at the time of collection and before we leave the site. We may accept cash, card or bank transfer, subject to availability. For business and account customers, separate payment terms may apply, which must be agreed in advance.
6.4 Late or non-payment
If payment is not made when due, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover all reasonable costs incurred in pursuing payment. We may also suspend or cancel further services until outstanding sums are settled.
7.1 Customer cancellations
You may cancel or reschedule your booking by giving us reasonable notice. Where possible, we request at least 24 hours notice prior to the scheduled collection time. If you cancel with insufficient notice, we may charge a cancellation fee or retain any deposit paid to cover our costs and loss of opportunity.
7.2 Our right to cancel
We may cancel or reschedule a booking due to unsafe conditions, extreme weather, vehicle breakdown, staff illness, access issues, misdescribed waste, or other circumstances beyond our control. In such cases, we will use reasonable endeavours to notify you as soon as practicable and to rearrange the service. We will not be liable for any indirect or consequential loss arising from such cancellation.
7.3 Waiting time
If our team is required to wait due to delays in gaining access, arranging payment, or other issues outside our control, we may charge a waiting time fee in accordance with our current rates.
8.1 Care and diligence
We will perform the services with reasonable care and skill, using appropriately trained staff and suitable vehicles and equipment for the job. Our team will take reasonable care when working on your premises, but you should remove or protect any delicate items or surfaces that could be damaged during the loading process.
8.2 Limits of service
Our service does not include deep cleaning, repairs, remedial works or removal of fixtures. We will not lift floor coverings or undertake structural alterations. Our staff are instructed not to move or handle items that are clearly unsafe or beyond reasonable manual handling limits.
8.3 Waste transfer and disposal
We will transport collected waste to licensed facilities for disposal, recycling or recovery in line with applicable waste management regulations. Where required, we will ensure that appropriate documentation is created and kept in accordance with duty of care obligations.
9.1 Accurate information
You must provide accurate and complete information regarding the waste, access, property layout and any hazards. Failure to do so may result in additional charges, service delays or cancellation.
9.2 Safety and cooperation
You must ensure that the collection area is reasonably clear, safe and free from hazards, and that children, pets and other occupants are kept away from the working area. You must follow any reasonable instructions given by our staff for safety reasons.
9.3 Ownership and authority
By presenting waste for collection, you confirm that you are the owner of the items or are authorised by the owner to dispose of them, and that the waste is free from third-party claims. You agree to indemnify us against any claims arising from the removal of items that you did not have the right to dispose of.
10.1 Loss or damage
We will be liable for direct physical damage to your property caused by our negligence, but our total liability for such damage will be limited to the reasonable cost of repair or replacement, subject to an overall cap equal to the total price paid or payable for the relevant service. We will not be liable for pre-existing damage or wear and tear.
10.2 Exclusions
We will not be liable for any loss of profits, loss of business, loss of opportunity, loss of data, or any indirect or consequential loss arising out of or in connection with our services, whether in contract, tort or otherwise, even if foreseeable.
10.3 Personal injury and death
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
10.4 Force majeure
We will not be in breach of these Terms and Conditions or liable for any delay or failure in performing our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, traffic disruption, accidents, strikes, civil disturbances, or failure of third-party networks.
11.1 Reporting issues
If you are dissatisfied with any aspect of our service, you should notify us as soon as possible, ideally within 48 hours of the collection, providing details of the issue and any supporting information. This allows us to investigate promptly.
11.2 Resolution
We will review your complaint and, where appropriate, may offer a remedy such as a partial refund, re-attendance or other reasonable solution. Any remedy will be at our discretion, subject to your statutory rights.
We will handle personal data that you provide to us in connection with bookings and the performance of our services in compliance with applicable data protection laws. We will use your data for purposes such as processing bookings, arranging collections, managing payments, customer service and legal compliance. We may keep records of collections and transactions for audit, regulatory and accounting purposes.
We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our services or business practices. Any updated version will apply to new bookings from the date of publication. For existing bookings, the terms in force at the time of booking will generally apply, unless a change is required by law.
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.
15.1 Entire agreement
These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and us regarding the provision of our services and supersede any prior discussions or understandings.
15.2 Severability
If any provision or part-provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted without affecting the validity of the remaining provisions.
15.3 No waiver
Our failure or delay in exercising any right or remedy under these Terms and Conditions shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another organisation as part of our business operations, provided that this does not reduce your rights under these Terms and Conditions.
